Terms of Service

1. Agreement

By authorizing the Software to connect to your Thumbtack account, or by using its dashboard, you agree to these terms. If you don't agree, don't connect your account or use the Software.

2. What the Software does

The Software connects to your Thumbtack Pro account, receives your incoming leads, and uses an AI model (Google Gemini) to draft and, unless you keep Test Mode on, automatically send replies to customers on your behalf. It also lets you take over any conversation yourself, schedule jobs on a calendar, and receive alerts by Telegram or SMS.

3. AI-generated replies

Replies sent by the Software are generated by an AI model based on the business information you provide (services, pricing rules, tone, hours). The AI can make mistakes. You are responsible for reviewing your business profile for accuracy, for monitoring the Leads tab, and for correcting or taking over any conversation that needs a human response. We do not guarantee that AI-generated replies will always be accurate, timely, or appropriate for every situation.

4. Test Mode

While Test Mode (also shown as "DRY_RUN") is on, no message is sent to a real customer - the Software simulates the flow using fake data. Turning Test Mode off means the Software will contact real Thumbtack customers automatically, unless Auto-reply is switched off.

5. Your responsibilities

• Keep your business profile (services, pricing, area, contact info) accurate and up to date.
• Comply with Thumbtack's own Terms of Service and Pro policies for your account.
• Use the Software only for lawful business purposes.
• Keep your dashboard password and any API keys or tokens you enter confidential.

6. Third-party services

The Software relies on Thumbtack, Google (Gemini API), and optionally Telegram and Twilio to function. Each of those is a separate service with its own terms, and we aren't responsible for their availability, changes, or errors. If one of them is down or changes its API, parts of the Software may stop working until it's fixed.

7. Availability, "as is"

The Software is provided "as is" and "as available," self-hosted on a server the business controls. We don't guarantee it will be uninterrupted, error-free, or available at all times. You are responsible for keeping the server it runs on secure and up to date.

8. Limitation of liability

To the fullest extent allowed by law, 2theMax Handyman Service is not liable for indirect, incidental, or consequential damages arising from your use of the Software, including a missed, delayed, or inaccurate reply to a customer. Nothing here limits liability that can't be limited under applicable law.

9. Your data

See our Privacy Policy for how information passing through the Software is collected, used, and stored.

10. Ending this agreement

You can stop using the Software and disconnect your Thumbtack account at any time from the dashboard's Businesses tab. We may suspend or end access if these terms are violated.

11. Changes

We may update these terms as the Software changes. Continuing to use the Software after an update means you accept the revised terms.

12. Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules.
